If you were to assist a client involved in a serious litigation in Japan where you cannot communicate in English with the relevant authorities, how would you deal with it?  Would translation resolve everything?

The speaker who has recently represented the bereaved family of Ms Lindsay Hawker in Japan will discuss his experience in this high profile cross-border matter and to address some practical issues which may arise in dealing with any cross-border litigation.

We hope this topical subject will spark lively debate amongst members.

There will be an opportunity after the seminar to socialise and network together.

Ken Kinukawa is a lawyer qualified in Japan and specialises in international corporate crime, corruption, anti-trust cases and global compliance issues.  The former First Secretary (Legal Attaché) of the Embassy of Japan in London, Ken has had a distinguished career as an attorney for the government in Japan during which he dealt with various international affairs including Mutual Legal Assistance and extradition. He has also worked in the Special Investigations Department of the Office of Tokyo Public Prosecution, where he investigated many complex corporate crime cases including bribery, fraud, false accounting and tax evasion. He was a former representative of Japan to the G8 Criminal Legal Affairs Subgroup (CLAS). Since 2009 he has been on a long term secondment from TMI Associates to Simmons & Simmons LLP, working with the EU Competition, the Crime, Fraud & Investigations, and the Employment Groups. He is currently based in the London office advising Japanese companies in various matters including general corporate advice. He also advises non Japanese people who are involved in various kinds of Japanese legal issues. Ken is a regular contributor to PLC Competition and Elexica to provide updates on Japanese legal trends. He regularly travels back to Japan to give talks at seminars and advice to clients in Japan.

The British Japanese Law Association (BJLA) is a bilateral law association which exists to promote understanding and exchange of knowledge between British and Japanese lawyers. It holds regular lectures, seminars and social events in London.
